Privacy Policy Overview

This privacy policy (the “Privacy Policy”) applies to the website http://www.vans.nl (the “Website”) and refers to the personal data processing activities performed by VF International S.a.g.l. – VANS Division (“VF”), who owns and operates the Website. The user’s personal data will be processed by VF when the user visits the Website and when the user interacts with the services and functionalities offered by the Website. The Privacy Policy has been drafted in accordance with the Recommendation n. 2/2001, adopted on May 17, 2001 by Article 29 Data Protection Working Party in relation to the minimum requirements for the collection of data on-line within the European Union and also represents information statement to the data subjects according to applicable privacy laws (the “Privacy Law”). The Privacy Policy specifies the identity of the data Controller that controls and manages the personal data collected and processed through the Website, specifies what is the personal information collected, the data processing purposes and conditions, the extent of personal data communication to third parties, the data security measures adopted in order to protect and safeguard data and the ways in which the  user may verify the processing of data relating to the user and enforce  the user’s rights as acknowledged under the Privacy Law.

VF Europe B.V.B.A. is acting as Privacy Representative of VF in Europe. The updated list of Processors and addresses of data communications is at your disposal at VF. Other companies of the VF group may be involved in the processing relating to the activities that may be performed on the Website (for example for accounting activities in case of purchase of products, for personnel selection activities) as specified in the Privacy Policy; they will act according to applicable privacy laws for the purposes herein specified.

What kind of data are processed; what are the purposes of the data processing

In general, the visit and consultation of the Website does not imply collection and processing of the user’s personal data. The processing of the user’s personal data who visits and consults the Website is limited to the so-named surfing data, namely the data whose transmission to the Website is implicit in the functioning of the information systems in charge of the managing of the Website and in the use of communications protocols peculiar to the Internet. Surfing data are, for example, the IP addresses or the domain names of the computers employed by the the user who connects to the Website and other parameters relating to the type and the information operating system employed by the the user. Surfing data, such as these above specified and for example the number of visits, the time spent on the Website are collected and processed by VF exclusively for statistical purposes and in anonymous form in relation to the access and use of the Website for purposes of monitoring the correct functioning of the Website and enhancing the Website functioning and content. Due to the nature itself of surfing data, these data may lead to identification of the users if they are associated with data held by third parties; however, VF does not collect surfing data in order to associate them with identified the users. Surfing data are deleted after the processing in anonymous form; said data may be used for purposes of assessing possible responsibilities in case of information crimes realized against the Website or through the Website. With the exception of the aforementioned circumstance, VF keeps the the user’s surfing data only for the maximum period of time allowed under applicable laws and then makes said data anonymous.

Furthermore, VF collects and processes personal data voluntarily provided by the user when the user interacts with the Website functionalities and requests the services offered by the Website, for example upon the user’s subscription to the Website; the user’s subscription to the newsletter or mailing list; the user’s purchase of products through the Website, which includes all activities relating to the purchase of goods, such as for example delivery of goods, billing issues, returning and exchanging of goods, receiving refunds, purchase and use of gift cards and e-gift cards, as applicable, payment related activities, including fraud prevention, and customer support and interaction with our call centre; the user’s participation in promotions and other initiatives realised through the Website such as for example  competitions and sweepstakes, the user requests  information from VF or the user sending  VF a question, communication or feedback through traditional mail or through the Website. We will process the user’s personal data to comply with laws, regulations and Community legislation, and to assess and defend a legal right. We may process the user’s personal data also when the user contacts our customer support and call centre, which may communicate with the user and thus process the user’s personal data through email, chat and telephone. The user may finalise the purchase of our products through telephone by contacting our call centre, following the procedure specified in our Terms and Conditions of Sale. For the processing of your personal data when you make a purchase on our Website, please see our relevant Privacy Statement. The call centre will assist the user in closing transactions over the phone and processing the user’s order on the user’s behalf and for said purpose it will collect the user’s personal data and credit card details. The call centre will also register the user’s phone number for the purpose of call-back and back-office services in order to provide the user with the requested support and information. Marketing, statistical and profiling activities as above specified may also be performed by the call centre, with the user’s consent. In some cases, for purposes of internal training, quality control and verification, the call may be recorded and the emails may be saved to the extent not prohibited by applicable laws. The user will always be informed in advance of the recording of the communication, and the user will have the opportunity to object to such recording, save when this is necessary for verification purposes in relation to your purchase or other reasons, as allowed under applicable laws.

With the user’s consent, which is optional, VF may further process the user’s personal data for survey purposes and  for marketing purposes, that is for sending  the user,  through email or other electronic communications  such as SMS, MMS, fax, etc.,  promotional information and material on products and services of the VF group, on special initiatives on prices and promotions of the VF group and on initiatives such as events, exhibitions and fairs organized by the VF group or to which the VF group takes part; and for profiling purposes. For the marketing and profiling activities above defined the user’s personal data may also be shared with other VF companies. The user will always have the opportunity to object, at any time and for free, to the processing of his/her personal data for the sending of promotional information and material; in each communication there will be a specific section in which are specified the conditions (easy to perform and free of charge) of revoking the consent.

Personal data that VF collects and processes includes name and contact details such as street address, telephone number, email address and further possible information of an optional nature provided by the user. In the relevant sections of the Website where data is collected a specific information statement is provided. When requested under the Privacy Law, VF requires the user’s consent before proceeding to process his/her personal data.

Where you have provided us with personal data about another person, (for example when using the function email  a friend, gift card functionalities or other purposes) to the extent permitted by applicable laws you hereby confirm that said communication and further processing by us as set out in this Privacy Policy complies with applicable privacy laws, so for example you should inform said person and as requested obtain his/her consent to the processing of his/her personal data for the purposes set out in this Privacy Policy.

Places where  your data is stored

Personal data collected through the Website will be processed by VF, the company Rackspace Ltd provides for VF hosting services for the web site and related database. VF Europe BVBA acts as Privacy Representative of VF in Europe. The updated list of Processors and addresses of data communications is at your disposal at VF. Personal data is processed only through specifically authorised staff designated to access and process the data, including staff designated for performance of non-routine maintenance operations of the Website. Furthermore, other companies of the VF group are involved in the processing of personal data in relation to the functioning of the Website and performance of the services and functionalities offered through the Website, for example in relation to purchase of products, customer support and call centre activities, and also for marketing and profiling activities as above specified. The user is invited to check the section of this Privacy Policy relating to Extent of personal data communication. All processors are acting on behalf and under the instructions of VF.

Cookies

Cookies are small data files stored on the hard disk of the users’ computer. The Website deploys cookies for specific and limited purposes, notably in order to offer to the user an easier surfing on the Website, to make login easier (for example by remembering the user’s  username and password), for internal security purposes, system administration, trend analysis. The cookies deployed by VF cannot be used to run programs on the user’s computer or to download viruses on the same, and they do not allow VF any kind of control on the user’s computer. VF does not use cookies to access information stored on the user’s computer, to store information on the same and to monitor the user’s operations. This section of the Privacy Policy relating to Cookies applies to cookies and any other tracking technology that may be used by VF and applies to the computer of the user as well as any other device employed by the user to connect to the Website.

‘Session cookies’ are stored in a temporary memory and are deleted when the user closes the browser. Session cookies do not collect any information from the user’s computer.

Cookies that are used upon subscription of the user to the Website collect the user’s personal information that allows VF to recognize the user in case of further visits  to the Website and they are used in order to create easier  surfing of the Website and the login procedure, allow VF to understand what are the sections of the Website that the user is most interested in order to offer to the user a personalised visit of the Website and of the information thereon published, and for security and managing purposes as above specified. The Website may contain links to other websites. VF does not have any type of access or control on cookies, web beacons and other   user tracking technologies that are present on third party websites that are accessible from the Website, on the availability and on any content or material contained in, or obtained through, any such websites, and on the conditions of processing of the user’s personal data by said third parties’ websites, and hereby expressly disclaims any relevant liability. VF invites the user to consult the privacy policy of third parties’ websites that the user accesses from the Website in order to be informed of the conditions of collection and processing of the user’s personal data, since this Privacy Policy only applies to the Website as above defined. Most web browsers automatically accept cookies, but the user can usually change their web browser to disable this function. The ‘Help’ section of the toolbar placed on the majority of browsers explains how to disable and avoid cookies, web beacons and other technologies employed to track t user behaviour,  . Disabling of cookies may limit the possibility to use the Website and may prevent the user from fully benefiting of the Website functionalities and services.

Conditions and features of the personal data processing

Personal data collected by VF is mainly processed through electronic and automated means but also without the same (paper processing), under procedures and logics that comply with the data processing purposes as herein specified. Personal data of the user  is processed according to applicable privacy laws, including security and confidentiality issues, and are kept only for the time strictly functional to achieve the specific data processing purpose from time to time pursued and according to applicable laws.

Security and quality of personal data

VF is committed to protect the security of the user’s personal data. Personal data is processed by VF in compliance with the security provisions as set forth by applicable laws in order to prevent loss and destruction, even accidental, of data, unauthorised access to data, unlawful or unfair use of data. Moreover, information systems and software programs are configured so that personal and identification data is used only when necessary to achieve the specific processing purpose from time to time sought.

VF deploys a variety of advanced security technologies and procedures to help protection of the user’s personal data against the risks outlined above. For example, personal data provided by the user is stored on secured servers placed in controlled locations. Moreover, for the transmission of some data through the Internet are deployed encryption techniques such as Secure Socket Layer (SSL) protocol.

The user may help VF to update and maintain accuracy of the personal data provided by the user to VF by notifying VF of any amendment relating to the user’s address, title, telephone number or electronic mail (email) address. Registered users may perform the foregoing online following the instructions reported on relevant  user profile pages of the Website.

Extent of personal data communication

VF communicates the user’s personal data within the limits and under the circumstances specified in this Privacy Policy and in the information statement published on the Website in the sections where data  is collected, in any case in full compliance with the consent given by the user upon collection of data, when required by the Privacy Law. The user’s personal data will be accessible within VF organisation by  internal and external personnel that need to access them because of their duties in relation to the processing purposes herein specified, our Processors if appointed and by our European Privacy Representative VF Europe BVBA. The updated list of Processors and of the subjects to which data may be communicated will remain at the user’s disposal free of charge upon request from VF.

The user’s personal data may be communicated to institutions, authorities, public entities, banks and financial institutions, professionals, independent consultants, also in associate form, business partners and third party service providers to which VF may revert to for performance of professional, technical and organizational services functional to the managing of the Website and the activities therein performed, such as for example the sales of goods and related activities, the managing of functionalities offered by the Website and of the initiatives and services that the user may subscribe to and require through the Website, and for services strictly functional to achievement of the other processing purposes herein specified. For purposes functional to the managing of the Website and related activities, for example for the purchase of goods through the Website or by  telephone  through our call centre, the user’s personal data may be also communicated to other companies of the VF group within the European Economic Area, save for VF International Sagl that is located in Switzerland, where transfer of data is allowed since Swiss privacy law has been recognized by the European Commission as providing an adequate level of data protection, that will process them according to applicable privacy laws for the purposes above specified, including marketing and profiling activities. With specific reference to the purchase of goods, data will be processed by the relevant local VF entity established in the place where delivery has to take place, acting as controller of your personal data in accordance with applicable privacy laws, for the following purposes: billing issues, despatch of goods, returning and exchanging of goods, receiving refunds, purchase and use of gift cards and e-gift cards as applicable, payment related activities, including fraud prevention. Moreover, for closing transactions and payment processing we revert to third party service providers for managing and support of the e-commerce platform. These service providers are bound by contractual obligations so that they will implement adequate security measures to protect security and confidentiality of the user’s personal data and credit card information.

The third parties receiving the user’s personal data as above specified will process data as Data Controllers, for example VF local entities, or Processors for example third party services providers, as the case may be, according to applicable data protection laws and for the same purposes above specified. Personal data may also be communicated to third parties in case of mergers, acquisitions and transfer of any of our assets, products, websites or operations. These third parties will be provided only with the information necessary to perform  their respective functions; they agree to use the information received only for the processing purposes above specified, to keep it confidential and secure and to comply with applicable law and the instructions received by VF. The third parties receiving your personal data are established within the European Economic Area and will process them under applicable privacy laws for the purposes above specified.

Except for the foregoing, the user’s personal data will not be shared with third parties, natural persons or legal entities that are unrelated to, or that do not perform a business, professional or technical function for VF. The user’s personal data may further be communicated to whoever is the legitimate addressee of communications as provided by applicable laws and regulations, thus for example in case of judicial processes, request by competent courts and authorities or other legal obligation, to protect and defend the rights and property of VF and the Website. The user’s personal data will not be communicated to third parties for their own marketing purposes and will under no circumstance be spread.

Providing of personal data

Except for the foregoing description in relation to the surfing data (please refer to the above section ‘The nature and kind of data processed’, providing of personal data by the user is necessary for performance of the services and functionalities offered by the Website and required by the user, such as the user’s subscription to the Website, to newsletters or mailing lists, the managing of the user’s purchase of products through the Website and related activities, the managing of the user’s participation  in promotions and other initiatives realised through the Website such as for example  competitions and sweepstakes, replying to and managing of the user’s request of information, questions, communication or feedback to VF. Providing of the user’s personal data for the activities necessary to comply with applicable legislation is mandatory. In the above referenced circumstances, denial of providing personal data by the user would make it impossible for VF to comply with contractual obligations or to provide the user with the requested services, products or information as above specified.

Providing of data by the user for  survey purposes,  marketing purposes  and  profiling purposes as above specified is optional; denial of providing personal data by the user in said circumstances will have no consequences on compliance by VF with its contractual obligations and on  providing the user with the services, products or information requested as above specified.

The user’s privacy rights

The user is entitled at any moment to enforce their rights as provided by applicable privacy laws, including but not limited to the right to obtain at any moment confirmation that the user’s personal data exists or does not exist, verify their content, origin and accuracy, ask for their integration, updating, amendment, deletion and the user may oppose for legitimate reasons the data processing (including objecting, at any time and for free, to the processing of his personal data for direct marketing purposes).

This Privacy Policy is subject to updating and amendment by VF. The version published on the Website is the version actually in force. If VF changes this Privacy Policy, VF will notify the user of such changes by posting a link on the home page of the Website to the amended privacy policy that reads “Newly Revised Privacy Policy”. VF invites the user to periodically review the Privacy Policy in order to be informed of any relevant change.

The Effective Date of this Privacy Policy is: April 1^st 2012.

Dit privacybeleid (het "Privacybeleid") is van toepassing op de website http://www.vans.nl (de "Website") en betreft de verwerking van persoonsgegevens door VF International S.a.g.l. – VANS Division ("VF"), eigenaar en exploitant van de Website. De persoonsgegevens van de gebruiker worden door VF verwerkt op het moment dat de gebruiker de Website bezoekt en op het moment dat de gebruiker gebruikmaakt van de op de Website aangeboden diensten en functionaliteiten. Dit Privacybeleid is opgesteld conform het bepaalde in Aanbeveling nr. 2/2001 d.d. 17 mei 2001 vastgesteld door de Groep voor Gegevensbescherming Artikel 29 in verband met het vastleggen van minimumvereisten voor het online verzamelen van persoonsgegevens binnen de Europese Unie, en geldt tevens als informatieverstrekking aan betrokkenen in de zin van de geldende privacywetgeving (de "Privacywet"). In dit Privacybeleid wordt toegelicht wie de verantwoordelijke is van de via de Website geregistreerde en verwerkte persoonsgegevens, welke persoonsgegevens geregistreerd worden, onder welke voorwaarden die gegevens verwerkt worden en waarom dit gebeurt, in hoeverre persoonsgegevens met derden worden uitgewisseld, de maatregelen die genomen worden ter beveiliging van persoonsgegevens, en de wijze waarop de gebruiker de verwerking van zijn/haar persoonsgegevens kan controleren en van zijn/haar rechten op grond van de Privacywet gebruik kan maken.

VF Europe B.V.B.A. treedt op als privacyvertegenwoordiger van VF in Europa. U kunt bij VF een actueel overzicht opvragen van de bewerkers en derden. Ook andere ondernemingen binnen de VF-groep kunnen betrokken zijn bij de verwerking van persoonsgegevens in verband met de activiteiten die via de Website worden verricht (b.v. in verband met de administratieve verwerking van de aankoop van producten en ten behoeve van de selectie van personeel) als bedoeld in dit Privacybeleid; deze ondernemingen houden zich alsdan aan de geldende privacywetgeving en verrichten hun activiteiten ten behoeve van het beoogde gebruik als vermeld in dit privacybeleid.

Welke persoonsgegevens worden verwerkt en met welk doel  

In het algemeen leidt een bezoek en het raadplegen van de Website niet automatisch tot registratie en verwerking van de persoonsgegevens van de gebruiker. De verwerking van persoonsgegevens van gebruikers die de Website bezoeken en raadplegen, is beperkt tot de zogenoemde surfgegevens, dat wil zeggen de gegevens die in verband met het functioneren van de informatiesystemen waarmee de Website wordt beheerd en in verband met het gebruik van communicatieprotocollen op internet, automatisch naar de Website worden gestuurd. Voorbeelden van surfgegevens zijn de IP-adressen en de domeinnamen van de computers vanaf waar gebruikers op de Website inloggen en andere parameters die verband houden met het specifieke besturingssysteem van de gebruiker. Deze surfgegevens, maar ook bijvoorbeeld het aantal keren dat de Website wordt bezocht en de duur van elk bezoek, worden door VF geregistreerd en verwerkt, doch uitsluitend voor statistische doeleinden, en geanonimiseerd. Op deze wijze wordt het functioneren van de Website bewaakt en kunnen het functioneren van de Website en de content van de Website verbeterd worden. Gezien de aard van de surfgegevens als zodanig, zijn deze gegevens herleidbaar tot de gebruikers wanneer de gegevens gekoppeld worden aan gegevensbestanden van derden. Surfgegevens worden echter niet door VF geregistreerd om deze te herleiden tot individuele gebruikers. De surfgegevens worden na geanonimiseerde verwerking verwijderd; deze gegevens kunnen wel gebruikt worden om vast te stellen wie verantwoordelijk is ingeval tegen of via de Website strafbare feiten zijn gepleegd. Behoudens in het hiervoor genoemde geval worden de surfgegevens ten hoogste voor de wettelijk toegestane periode door VF bewaard, waarna deze gegevens door VF worden geanonimiseerd.

Voorts registreert en verwerkt VF de persoonsgegevens die vrijwillig door de gebruiker worden verstrekt wanneer hij/zij gebruikmaakt van de functionaliteiten op de Website en van de diensten die via de Website worden aangeboden, zoals aanmelding voor de Website, aanmelding voor de nieuwsbrief of mailinglijst, de aankoop van producten via de Website, waaronder alle verkoopgerelateerde activiteiten worden verstaan, zoals de aflevering van producten, facturering, retourzendingen en het omruilen van producten, restituties, aanschaf en gebruik van gewone cadeaubonnen c.q. digitale giftcards, betaalactiviteiten, met inbegrip van fraudepreventie, klantenservice en contacten met ons callcenter; de deelname van de gebruiker aan speciale acties en andere initiatieven die via de Website lopen, zoals prijsvragen en zogenoemde 'sweepstakes', informatieaanvragen van de gebruiker en vragen, berichten en feedback die de gebruiker per gewone post of via de Website aan VF doet toekomen. Wij verwerken de persoonsgegevens van de gebruiker ten behoeve van de naleving van nationale en Europese wet- en regelgeving en ter vaststelling en uitoefening van wettelijke rechten. De persoonsgegevens van de gebruiker worden ook geregistreerd wanneer hij/zij contact opneemt met de klantenservice in ons callcenter. Aangezien het callcenter contact onderhoudt met de gebruiker, registreert het de persoonsgegevens die het via e-mail, chatprogramma's of telefonisch heeft ontvangen. De gebruiker kan de aankoop van onze producten ook telefonisch tot stand brengen door ons callcenter te bellen volgens de procedure zoals beschreven in onze Algemene Verkoop- en Leveringsvoorwaarden (link). Voor informatie over de verwerking van uw persoonsgegevens wanneer u via de Website producten koopt, verwijzen wij naar de betreffende privacyverklaring (link). Het callcenter helpt de gebruiker bij de telefonische totstandkoming van transacties en verwerkt vervolgens de betreffende order namens de gebruiker. Voor deze doeleinden worden de persoons- en creditcardgegevens van de gebruiker verzameld. Het callcenter registreert het telefoonnummer van de gebruiker zodat hij/zij teruggebeld kan worden, alsmede ten behoeve van backoffice-diensten, zodat de gebruiker de gewenste ondersteuning en informatie geboden kan worden. Met toestemming van de gebruiker kunnen de hiervoor vermelde marketing-, statistische en profileringsactiviteiten ook door het callcenter worden verricht. In sommige gevallen worden telefoongesprekken opgenomen en worden e-mailberichten opgeslagen ten behoeve van interne trainingen, kwaliteitscontroles en verificatiedoeleinden, voor zover dit niet wettelijk is verboden. Wanneer het gesprek wordt opgenomen, wordt de gebruiker daar altijd vooraf op gewezen en kan hij/zij dit weigeren, behalve wanneer de opname nodig is ter verificatie van een aankoop of om andere redenen noodzakelijk is, voor zover dit wettelijk is toegestaan.

Met toestemming van de gebruiker, die hij/zij mag maar niet hoeft te verlenen, verwerken wij de persoonsgegevens van de gebruiker tevens voor onderzoeks- en marketingdoeleinden, dat wil zeggen dat wij reclamemateriaal en informatie over producten, diensten, kortingsacties en aanbiedingen van de VF-groep en informatie over initiatieven zoals evenementen, shows en beurzen die door de VF-groep worden georganiseerd of waaraan VF-ondernemingen deelnemen, per e-mail of via een ander elektronisch communicatiemiddel, zoals sms, mms, fax e.d., aan de gebruiker toesturen, alsmede ten behoeve van het in kaart brengen van klantenprofielen. Bepaalde persoonsgegevens van de gebruiker kunnen ten behoeve van de hiervoor beschreven marketing- en profileringsactiviteiten ook worden uitgewisseld met andere VF-ondernemingen. De gebruiker heeft altijd de gelegenheid om kosteloos bezwaar te maken tegen de verwerking van zijn/haar persoonsgegevens voor het toesturen van reclame en informatie over speciale acties; in elk bericht dat wij toesturen, is een specifieke bepaling opgenomen waarin uitgelegd wordt hoe een eerder verleende toestemming (eenvoudig en zonder kosten) kan worden ingetrokken.

De door VF geregistreerde en verwerkte persoonsgegevens betreffen namen en contactgegevens zoals huisadres, telefoonnummer, e-mailadres en andere door de gebruiker verstrekte optionele gegevens. Op de pagina's van de Website waar persoonsgegevens worden ingevuld, staat een specifieke mededeling hierover. Wanneer de Privacywet zulks voorschrijft, heeft VF voorafgaande toestemming van de gebruiker nodig om diens persoonsgegevens te mogen verwerken.

Wanneer u de persoonsgegevens van iemand anders aan ons heeft doorgegeven (bijvoorbeeld door gebruik te maken van de functie 'e-mail een vriend', giftcard-functionaliteiten e.d.), voor zover dit op grond van het toepasselijke recht is toegestaan, bevestigt u hierbij dat die doorgifte en de verdere verwerking door ons conform dit Privacybeleid in overeenstemming zijn met de geldende privacywetgeving. Dit betekent bijvoorbeeld dat u de betreffende persoon dient te informeren over de doorgifte van diens gegevens en desgevraagd zijn/haar toestemming dient te verkrijgen voor de verwerking van die persoonsgegevens voor het beoogde gebruik als vermeld in dit Privacybeleid.

Plaatsen waar uw persoonsgegevens opgeslagen worden

De via de Website geregistreerde persoonsgegevens worden verwerkt door VF; het bedrijf Rackspace Ltd verzorgt voor VF de hosting van de website en de bijbehorende database. VF Europe BVBA treedt op als privacyvertegenwoordiger van VF in Europa. U kunt bij VF een actueel overzicht opvragen van de bewerkers en derden. De verwerking van persoonsgegevens geschiedt uitsluitend door specifiek daartoe aangewezen medewerkers die bevoegd zijn om die persoonsgegevens in te zien en te verwerken, met inbegrip van medewerkers die belast zijn met de uitvoering van niet-routinematig onderhoud aan de Website. Ook andere ondernemingen binnen de VF-groep zijn bij de verwerking van persoonsgegevens betrokken in verband met het functioneren van de Website en de uitvoering van diensten en functionaliteiten die via de Website worden aangeboden, bijvoorbeeld in verband met de aanschaf van producten, de klantenservice en de activiteiten van het callcenter, alsmede voor de hierboven genoemde marketing- en profileringsactiviteiten. Wij raden de gebruiker aan om ook het bepaalde door te lezen onder Omvang van uitwisseling van persoonsgegevens. Alle bewerkers handelen namens en op aanwijzing van VF.

Cookies

Cookies zijn kleine gegevensbestanden die zich bevinden op de harde schijf van de computer van de gebruiker. Cookies worden gebruikt voor specifieke, beperkte doeleinden, met name om het inloggen en surfen op de Website voor de gebruiker makkelijker te maken (de gebruikersnaam en het wachtwoord van de gebruiker worden bijvoorbeeld onthouden), alsmede voor interne beveiligingsdoeleinden, systeembeheer en de analyse van trends. De cookies die VF gebruikt, kunnen niet worden aangewend om programma's op de computer van de gebruiker te laten draaien of om virussen op de computer van de gebruiker te downloaden. De cookies geven VF geen enkele controle over de computer van de gebruiker. De cookies worden niet door VF gebruikt om toegang te verkrijgen tot informatie op de computer van de gebruiker, om informatie op diens computer op te slaan of om de activiteiten van de gebruiker na te gaan. De onderhavige bepalingen inzake cookies zijn van toepassing op cookies en op alle andere, door VF gehanteerde tracking-technieken en hebben betrekking op de computer van de gebruiker en op alle andere apparatuur waarmee de gebruiker verbinding maakt met de Website.

'Sessie-cookies' worden in een tijdelijk geheugen opgeslagen en worden verwijderd wanneer de gebruiker de browser afsluit. Sessie-cookies registreren geen gegevens van de computer van de gebruiker.

Met de cookies die gebruikt worden bij aanmelding op de Website, worden de persoonsgegevens van de gebruiker geregistreerd die VF nodig heeft om de gebruiker te herkennen bij een volgend bezoek aan de Website. Deze cookies worden tevens gebruikt om het inloggen en het surfen op de Website makkelijker te maken, om een idee te krijgen van de gedeeltes van de Website die de gebruiker het meest interessant vindt, zodat meer op maat gesneden informatie op de Website kan worden aangeboden en een gerichter bezoek mogelijk is, alsmede ten behoeve van de beveiliging en administratie zoals eerder al is aangegeven. Op de Website kunnen links naar andere websites worden opgenomen. VF heeft geen enkele toegang tot of invloed op cookies, beacons en andere tools voor het volgen van gebruikers die worden gebruikt op de websites van derden die vanaf de Website bereikbaar zijn, of op de beschikbaarheid, de inhoud en het materiaal dat op die websites staat of via die websites verkrijgbaar is, of op de voorwaarden waaronder de persoonsgegevens van de gebruiker via die websites van derden worden verwerkt. Alle aansprakelijkheid van VF ter zake wordt hierbij uitdrukkelijk uitgesloten. VF raadt de gebruiker aan om het privacybeleid van de websites van derden te raadplegen, zodat de gebruiker weet onder welke voorwaarden zijn/haar persoonsgegevens aldaar geregistreerd en verwerkt worden. Het onderhavige Privacybeleid is namelijk uitsluitend van toepassing op de hiervoor beschreven Website. Bij de meeste webbrowsers worden cookies automatisch geaccepteerd. In de meeste browsers kan deze functie echter door de gebruiker worden uitgezet. Op de werkbalk van de meeste browsers wordt onder 'Help' uitgelegd hoe cookies, beacons en andere tracking-tools kunnen worden geweerd en uitgeschakeld. Het blokkeren van cookies kan betekenen dat de Website minder goed te gebruiken is en dat de gebruiker niet optimaal van alle aangeboden functionaliteiten en diensten gebruik kan maken.

Voorwaarden en procedure voor gegevensverwerking

De verwerking van door VF geregistreerde persoonsgegevens geschiedt grotendeels elektronisch en automatisch, maar soms ook handmatig (op papier), waarbij procedures en logische processen worden gehanteerd die aansluiten bij het beoogde gebruik als vermeld in dit Privacybeleid. De verwerking van de persoonsgegevens van de gebruiker geschiedt conform de geldende privacywetgeving, met inbegrip van de voorschriften inzake beveiliging en geheimhouding. De gegevens worden uitsluitend bewaard zolang dit nodig is voor het alsdan specifiek beoogde doel, zulks met inachtneming van het bepaalde in de wet.

Beveiliging en kwaliteit van persoonsgegevens  

VF hecht groot belang aan de beveiliging van de persoonsgegevens van de gebruiker. VF verwerkt deze persoonsgegevens overeenkomstig de voorschriften inzake beveiliging zoals die in de geldende wet- en regelgeving worden gesteld ter voorkoming van (onbedoeld) gegevensverlies en schade aan persoonsgegevens, onbevoegde toegang tot persoonsgegevens en onrechtmatig of oneigenlijk gebruik van persoonsgegevens. Bovendien zijn de informatiesystemen en de softwareprogramma's zodanig ingericht dat persoons- en ID-gegevens uitsluitend worden gebruikt wanneer dat nodig is voor het alsdan specifiek beoogde gebruik.

VF hanteert diverse geavanceerde beveiligingstechnieken en -procedures om de persoonsgegevens van de gebruiker te beveiligen tegen de hiervoor genoemde risico's. Zo worden de door de gebruiker verstrekte persoonsgegevens opgeslagen op beveiligde servers op bewaakte locaties. Daarnaast worden voor de verzending van bepaalde persoonsgegevens via internet versleutelingstechnieken toegepast zoals het Secure Socket Layer (SSL)-protocol.

De gebruiker kan VF helpen bij het actueel houden van de door hem/haar verstrekte persoonsgegevens door wijzigingen in adres, functie, telefoonnummer en e-mailadres aan VF door te geven, zodat de persoonsgegevens van de gebruiker altijd actueel en juist zijn. Geregistreerde gebruikers kunnen dit online doen door de aanwijzingen op de betreffende profielpagina van de Website te volgen.

Omvang van uitwisseling van persoonsgegevens

VF wisselt de persoonsgegevens van de gebruiker uit binnen de grenzen en onder de voorwaarden als vermeld in dit Privacybeleid en in de mededeling op de webpagina's waar persoonsgegevens worden ingevuld, zulks altijd met inachtneming van de toestemming die de gebruiker ten tijde van de registratie van zijn/haar gegevens heeft verleend, mocht dit door de Privacywet worden vereist. De persoonsgegevens van de gebruiker zijn binnen de VF-organisatie toegankelijk voor interne en externe medewerkers die deze persoonsgegevens nodig hebben voor de uitvoering van hun werkzaamheden in verband met de beoogde verwerking als vermeld in dit Privacybeleid, voor eventueel door ons aangewezen bewerkers en voor onze Europese privacyvertegenwoordiger VF Europe BVBA. De gebruiker kan bij VF kosteloos een actueel overzicht opvragen van de bewerkers en van degenen met wie gegevens kunnen worden uitgewisseld.

De persoonsgegevens van de gebruiker kunnen worden uitgewisseld met (overheids)instanties, banken en financiële instellingen, professionals, onafhankelijke adviseurs, met inbegrip van adviesbureaus, zakenpartners alsmede met externe dienstverleners die door VF worden ingeschakeld voor de levering van professionele, technische en organisatorische diensten ter zake van het beheer van de Website en de activiteiten die via de Website lopen, zoals de verkoop van producten en bijbehorende activiteiten, het beheer van de functionaliteiten die via de Website worden aangeboden, de uitvoering van initiatieven en diensten waarvoor de gebruiker zich via de Website kan aanmelden of die hij/zij via de Website kan aanvragen, alsmede voor diensten die strikt noodzakelijk zijn voor de overige verwerking als vermeld in dit Privacybeleid. Wanneer dit nodig is voor het beheer van de Website en de bijbehorende activiteiten, bijvoorbeeld voor de aanschaf van producten via de Website of telefonisch via ons callcenter, kunnen de persoonsgegevens van de gebruiker tevens worden uitgewisseld met andere VF-ondernemingen die binnen de Europese Economische Ruimte zijn gevestigd, met inbegrip van VF International Sagl. Dit bedrijf is weliswaar gevestigd in Zwitserland, maar gegevensoverdracht met Zwitserland is toegestaan aangezien de Zwitserse privacywetgeving naar het oordeel van de Europese Commissie een voldoende niveau van gegevensbescherming biedt. Deze ondernemingen verwerken uw gegevens met inachtneming van de geldende privacywetgeving voor het hiervoor beschreven doeleinden, met inbegrip van marketing- en profileringsactiviteiten. Wat de aanschaf van producten betreft, worden persoonsgegevens verwerkt door de VF-onderneming in het land waar de producten moeten worden afgeleverd, in welk geval deze onderneming met inachtneming van de geldende privacywetgeving als verantwoordelijke van uw persoonsgegevens optreedt voor de volgende doeleinden: facturering, verzending van producten, retourzendingen, omruilen van producten, restituties, aankoop en gebruik van gewone cadeaubonnen en digitale giftcards, betaalactiviteiten, met inbegrip van fraudepreventie. Verder schakelen wij voor de afwikkeling van transacties en de verwerking van betalingen externe dienstverleners in ten behoeve van het beheer en de ondersteuning van het e-commerce-platform. Deze dienstverleners zijn contractuele verplichtingen aangegaan en dienen op grond daarvan afdoende veiligheidsmaatregelen te treffen ter beveiliging en geheimhouding van de persoons- en creditcardgegevens van de gebruiker.

Derden aan wie op grond van het vorenstaande persoonsgegevens van de gebruiker zijn doorgegeven, verwerken die gegevens als verantwoordelijke (bijvoorbeeld lokale VF-ondernemingen) of als bewerker (bijvoorbeeld externe dienstverleners, afhankelijk van de omstandigheden), zulks conform de geldende wet- en regelgeving en voor dezelfde doeleinden als hiervoor vermeld. Persoonsgegevens kunnen ook aan derden worden doorgegeven ingeval van een fusie, overname of gehele of gedeeltelijke overdracht van onze activa, producten, websites of activiteiten. Persoonsgegevens worden uitsluitend aan deze derden verstrekt voor zover zij die gegevens nodig hebben ter uitvoering van hun betreffende functie, waarbij zij zich verplichten om die persoonsgegevens uitsluitend voor het beoogde gebruik als hiervoor vermeld te verwerken en zich voorts verbinden tot geheimhouding en beveiliging van die persoonsgegevens alsmede tot naleving van de geldende wet- en regelgeving en de van VF ontvangen aanwijzingen. Deze derden die uw persoonsgegevens ontvangen, zijn gevestigd binnen de Europese Economische Ruimte en verwerken uw persoonsgegevens met inachtneming van de geldende privacywetgeving voor het hiervoor beschreven doeleinden.

Behoudens het vorenstaande worden de persoonsgegevens van de gebruiker niet uitgewisseld met derden, natuurlijke dan wel rechtspersonen, wanneer deze niet gelieerd zijn aan c.q. geen zakelijke, professionele of technische werkzaamheden verrichten voor VF. De persoonsgegevens van de gebruiker kunnen voorts worden uitgewisseld met personen die op grond van de geldende wet- en regelgeving als rechtmatige ontvanger van die gegevens worden aangemerkt. Ingeval van een juridische procedure is dat bijvoorbeeld de bevoegde rechter of een andere bevoegde instantie die inzage in bepaalde gegevens verlangt. Verder kan VF persoonsgegevens bekendmaken wanneer zij daartoe wettelijk verplicht is, dan wel om op te komen voor haar rechten of ter bescherming van haar eigendommen en de Website. Uw persoonsgegevens worden niet aan derden verstrekt ten behoeve van hun eigen marketing en worden onder geen beding verspreid.

Verstrekking van persoonsgegevens

Behoudens het hiervoor bepaalde omtrent surfgegevens (zie onder Welke persoonsgegevens worden verwerkt en met welk doel), hebben wij de persoonsgegevens van de gebruiker nodig voor de levering van de diensten en de functionaliteiten die op de Website worden aangeboden en door de gebruiker zijn aangevraagd, zoals diens aanmelding voor de Website, voor nieuwsbrieven of mailinglijsten, de verwerking van aankopen via de Website en bijbehorende activiteiten, de administratieve verwerking van de deelname van de gebruiker aan speciale acties en andere initiatieven die via de Website worden gerealiseerd, zoals prijsvragen en zogenoemde 'sweepstakes', de behandeling van informatieaanvragen en andere vragen, berichten en feedback van de gebruiker. De gebruiker is verplicht om persoonsgegevens te verstrekken wanneer dit nodig is om aan de geldende wet- en regelgeving te voldoen. In de hiervoor geschetste omstandigheden heeft een weigering om persoonsgegevens te verstrekken tot gevolg dat VF niet aan haar contractuele verplichtingen kan voldoen c.q. de gewenste diensten, producten of informatie niet aan de gebruiker kan leveren.

Het verstrekken van persoonsgegevens door de gebruiker ten behoeve van onderzoek, marketing of het opstellen van klantenprofielen, een en ander als hiervoor vermeld, is optioneel. Wanneer de gebruiker dit weigert, heeft dit geen gevolgen voor de nakoming van de contractuele verplichtingen van VF of voor de levering van de door de gebruiker gewenste diensten, producten of informatie.

De privacyrechten van de gebruiker

De gebruiker kan te allen tijde gebruikmaken van zijn/haar rechten ingevolge de geldende privacywetgeving, met inbegrip van maar niet beperkt tot het recht om te weten of zijn/haar persoonsgegevens al dan niet staan geregistreerd, om de inhoud, bron en juistheid van die gegevens te controleren, een verzoek in te dienen inzake het opnemen, actualiseren, wijzigen of verwijderen van die gegevens, alsmede om op rechtmatige gronden bezwaar te maken tegen de verwerking van zijn/haar persoonsgegevens (bijvoorbeeld ten behoeve van direct marketing; dit kan te allen tijde en brengt geen kosten met zich mee).

Dit Privacybeleid kan door VF geactualiseerd en gewijzigd worden. De versie die op de Website staat, is de versie die van toepassing is. Ingeval van een wijziging van dit Privacybeleid wordt de gebruiker daarvan in kennis gesteld via de link "Gewijzigd Privacybeleid" op de homepage van de Website. VF raadt de gebruiker aan om het Privacybeleid regelmatig te raadplegen, zodat hij/zij op de hoogte blijft van eventuele wijzigingen.

Dit Privacybeleid treedt in werking op: 1 april 2012.
